1. Authorization of Products
The products sold are intended only for the use(s) identified by the manufacturer. They are not to be used for purposes other than those specified, including, but not limited to, unauthorized commercial purposes, in foods, for drug administration or for cosmetics for humans or animals. The buyer acknowledges that as the seller's products are, unless otherwise specified, intended for research purposes, they may not be on the Toxic Substances Control Act (TSCA) inventory. The buyer therefore assumes responsibility to ensure that the products purchased from the seller are approved for use under TSCA, if applicable.
The buyer accepts that these products have not been tested for safety in commercial, cosmetic, drug, food or medical device usages, unless otherwise specified. The buyer agrees to properly test, use, manufacture and market, to the extent authorized, any products acquired from the seller in accordance with the practices of a reasonable person who is an expert in the field and in strict compliance with all applicable federal, state and local laws and regulations.
The buyer warrants to the seller that any material or final articles manufactured from products purchased from the seller shall not be adulterated or misbranded within the meaning of the Federal Food, Drug and Cosmetic Act and shall not be materials which may not, under Sections 404, 405, or 512 of the Act, be introduced into interstate commerce. The buyer accepts the responsibility of conducting any and all research necessary to learn the risks, if any, involved for uses of products purchased from the seller.
The buyer also agrees to warn customers, employees and any supplementary personnel of any hazards, if any, involved in using or handling the products. The buyer consents to train and inform its employees of the risks and hazards, if any, of using or handling the products distributed by the seller, and to train and prepare them for the proper and safe handling of these products.
2. Purchasing and Payment Policy
Prices shown are in U.S. dollars and are subject to change. The minimum order requirement for all purchases is $110.00. In addition to the listed price on the web site, the buyer agrees to pay fees that may be added for shipping, handling and any applicable insurance. These fees will be prepaid and added to the final charge and the user will be notified of these fees prior to charging the user's credit card. The seller accepts both MasterCard and Visa credit cards. The seller shall automatically charge the buyer's account and supplied credit card information for all orders which are placed.
3. Taxes and Other Charges
The buyer agrees to pay any applicable taxes, including use tax, sales tax, excise tax, duty, custom, inspection or testing fee, or any other tax, fee or charge of any nature whatsoever imposed by any governmental authority, on or measured by the transaction between the seller and the buyer.
4. Indemnification
The buyer agrees that the seller shall not be liable in any event for incidental, consequential or special damages of any kind, including, but not limited to, lost revenues and profits, failure to realize savings, loss of work in progress or any liability of buyer to a third party on account of such losses, or for any labor or any other expense, even if the seller has been advised of the possibility of such damage. The buyer agrees to indemnify and hold the seller harmless from any claims, charges, losses or costs (including attorney's fees and other expenses of defending any action) that arise from the buyer's possession or use of the seller's products or any related activities. The buyer shall cooperate fully with the seller in the investigation and determination of the cause of the claim, making available to the seller all statements, reports and tests made by the buyer or made available to the buyer by others. Supplying this information to the seller and any investigation conducted by the seller shall not constitute an assumption of any liability by the seller. Victor - G. & Company's liability is limited to replacement of products only; at it's discretion if products are determined to be defective by Victor - G. & Company.
5. Compliance with Laws and Regulations
The seller certifies, to the best of its knowledge, that the products are produced in compliance with the applicable requirements of the Fair Labor Standards Act, as amended, and the Occupational Safety and Health Standards Act of 1970.
6. Cancellations
Once an order is placed and processed, orders may not be cancelled.
7. Return Policy
If you are not satisfied with your purchase, please contact us within 15 days of the order's ship date. You may return a product only if the item is defective. We request that you send proof of the damage by e-mailing a digital photograph of the defective parts to crm@victor-g.com. We will then issue a Return Materials Authorization (RMA) number to you. To ensure prompt handling, the RMA number should be clearly marked on the outside of the package when returned. In the event of a package that appears to be damaged from shipping, please reject the shipment from the carrier at the time of receipt and Victor - G. & Company will send a replacement shipment.
